LEGAL NOTICE

On Tuesday, November 1, 2022 at 7:00 P.M. prevailing time, the Phoenixville Borough Council will consider an Ordinance authorizing the Condemnation by Eminent Domain to acquire, in fee simple, certain real property located in the Borough of Phoenixville.

Section 1 sets forth the statutory authority for the condemnation action and lists the property to have condemned rights established upon as Tax Parcel 15-4-10, references a legal description and sets forth the right to acquire fee simple title to the subject property. Section 2 provides for severability if any provision or phrase of this Ordinance is held to be unconstitutional or otherwise invalid.  Section 3 repeals ordinances or parts of ordinances insofar as they are inconsistent with this Ordinance. Section 4 provides for the Ordinance to become effective upon enactment as provided by law.

Due to the requirement of social distancing, public participation at these meetings will occur through remote connections, via computer, tablet, smartphone or phone in supplement to in-person.  Telecommunications participation will allow any member of the public to indicate they would like to speak and offer comment during the public comment portion of the meetings. Residents and taxpayers who wish to participate or listen to the meeting may call-in or log-in.  Directions for connection to and participation in the meetings will be published on the Borough’s publicly accessible website at www.phoenixville.org.

PLEASE TAKE NOTICE that on Tuesday, November 1, 2022 at 7:00 P.M. prevailing time, during its regular monthly business meeting, the Phoenixville Borough Council intends to consider and take action on an ordinance accepting the dedication of the right-of-way of Ashburn Road and Bunning Road in the vicinity of their intersection with Fillmore Street in Phoenixville Borough, Chester County, Pennsylvania, which roads are currently part of the property identified as Chester County Uniform Parcel Identifier (UPI) No. 15-4-10 (the “Ordinance”).

Due to the requirement of social distancing, public participation at these meetings will occur through remote connections, via computer, tablet, smartphone or phone in supplement to in-person.  Telecommunications participation will allow any member of the public to indicate they would like to speak and offer comment during the public comment portion of the meetings. Residents and taxpayers who wish to participate or listen to the meeting may call-in or log-in.  Directions for connection to and participation in the meetings will be published on the Borough’s publicly accessible website at www.phoenixville.org.   

Consistent with the provisions of 8 Pa.C.S. §§1731 & 1734, as amended, this notice is the first of two publications intended to provide notification that Ordinance will be considered and acted upon, and that any legally interested person desiring a hearing on such Ordinance may request the same in writing provided to the Borough at the below address no later than ten (10) days after the second of the two publications hereon.

An Ordinance Amending The Code Of Ordinances Of The Borough Of Phoenixville For The Purpose Of Repealing The Current Chapter 7 “Fire Prevention And Fire Protection” In Order To Enact An Updated Chapter 7 “Fire Prevention And Emergency Services”
